Terms and Conditions
	To be an authorized affiliate of Daily.co.uk, you agree to abide by the terms and conditions contained in this agreement. Please read this agreement carefully before registering and using the Daily.co.uk service as an affiliate. By signing up for the Daily.co.uk affiliate program, you indicate your acceptance of this agreement and its terms and conditions. Application to Join the Program Once you have submitted your application to join the Daily.co.uk Affiliate Program we will evaluate your application to ensure that you comply with all our rules. He have the right to reject your application if we determine that your website is unsuitable for the Program for any reason, including, but no limited to if your site contains images or content that is unlawful, obscene, defamatory or harassing, or facilitate illegal activity, promote violence or promote or assist others in promoting copyright infringement. Utilising Links on Your Web site As an affiliate of Daily.co.uk you are entitled to use any form of promotion you choose consistent with the terms of the Agreement. You may not participate in the sending of unsolicited bulk e-mails and any activity by you, or on your behalf which we determine or reasonably suspect to be the case will immediately terminate your participation in the Program and your forfeiting of monies otherwise due to due. Allowable links can be found inside your Affiliate control panel and can only be altered or modified with our consent. Commissions Daily.co.uk will pay commission based on the following: A commission rate of 30% of the purchase price before VAT. The commission rate is subject to change from time to time and you will receive e-mail notification of any changes 30 days before any such changes take effect. Commissions due will be paid directly by Daily.co.uk once per calendar month on the 7th day of the month. Payments will be in the form of PayPal or a Daily.co.uk cheque payable to you as identified in your application and mailed to you at the address held on your account. There will be a 30 day hold from the time you generate a commission and the time that you become eligible to be paid. If, during the 30 day hold the referral takes advantage of our 30 day money back guarantee your commission will become void. Commission will not be paid on services ordered for your own use, or that of anyone else in your organization. Termination You will forfeit the right to participate in the Daily.co.uk Afffiliate program if you participate in any of the following, or we have reason to suspect that you are participating in any of the following activities. These include but are not limited to: The sending of unsolicited bulk e-mails IRC postings of any other form of spamming Provision of inaccurate or incomplete information to Daily.co.uk concerning your identy. Attempting to cheat, defraud or mislead us in any way Misrepresentation to the public in the terms and conditions of your site Engagement in popup advertisement network activities Term of the Agreement The term of this Agreement will begin upon our acceptance of your Program application and will end when terminated by either party. This agreement can be terminated by either party at any time. E-mail notification is considered sufficient notice to terminate this Agreement. If this Agreement is terminated by us for violation of the terms of this Agreement you will not be eligible to receive any commissions which may be due or earned prior to the date of termination. If this Agreement is terminated for any other reason, you are only eligible to earn a commission on sales occurring during the term. We reserve the right to withhold your final payment for a reasonable time to ensure that the correct amount is paid. Relationship You and Daily.co.uk are independent contractors and nothing in this Agreement will create any partnership, joint venture, agency franchise, or any other relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You are not an agent of Daily.co.uk and Daily.co.uk expressly disclaims responsibility for any conduct by you in violation of our terms of agreement. Limitation of Liability Daily.co.uk does not accept responsibility for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with the Agreement of the Affiliate Program. Further, our aggregate liability arising with respect to this Agreement and the Affiliate Program will not exceed the total commissions paid or payable to you under this Agreement. Disclaimer Daily.co.uk makes no express or implied warranties or representations with respect to the Affiliate Program or any company services or other items sold through the Program. In addition Daily.co.uk makes no representation that the operation of our site will be uninterrupted or error-free, and will not be liable for the consequences of any interruptions or errors. Indemnification You hereby agree to indemnify, defend and hold harmless Daily.co.uk, officers, directors, employees, agents, affiliates, successors and assigns, from and against any and all claims, losses, liabilities, damages or expense of any nature whatsoever incurred or suffered by us (collectively the “Losses”), in so far as such Losses arise out of or based on any claim or threatened claims that our use of the Affiliate Trademarks infringes on the rights of any third party; the breach of any promise, covenant, representation or warranty made by you herein; or any claimed related to your side. This is a legal agreement between you and Daily.co.uk. By clicking on the “join” button at the end of this agreement you are stating that you have read, understood and agree to abide by the terms set forth herein.
